Old Bridge has some of the highest heroin abuse cases reported in New Jersey with 192 in 2012 and 178 in 2013 based on reports from the Division of Addiction Services in the New Jersey Department of Human Services. (Statistics for 2014 have not been released yet) However, the problem goes far beyond Old Bridge, as there are two towns in Middlesex County alone that have more reported heroin use. The reported heroin abuse cases are only the ones that police and emergency personnel know about and most translate into arrests and charges for Heroin Possession, being under the influence of CDS, or possession of a hypodermic needle. However, these statistics do not include the countless others arrested for heroin which is found as the result from motor vehicle stops and search warrants. A significant amount of these charges result in Heroin Distribution cases as the law assumes you have an intent to distribute the drug to others if you have numerous folds or decks on you – which is often referred to as “bundles” and “bricks”. However, in reality most users have numerous bags in their possession and use as many as 10 doses each day in order to feed their growing habit.

An experienced criminal defense attorney can be invaluable when it comes to challenging the legal standards and elements of the State’s case against. Moreover, your lawyer can serve as your advocate and take the position that you are more deserving of treatment rather than incarceration for the incident that you have been charged for. Our attorneys have defended clients against hundreds of heroin charges and related crimes and we are often able to secure a downgrade of the charges or admittance in to Pre-Trial Intervention for first time offenders so that the charges are dismissed upon successful completion. For clients with prior records, we are often able to secure non-custodial probation or Drug Court, when circumstances allow, so incarceration is avoided. To learn more about how we may be able to help you or your loved one, contact our office today for a free consultation.

Edison Mayor Thomas Lankey is among the latest of local and national politicians dealing with a child battling a drug problem. Heroin addiction is real and it is prevalent in New Jersey. Despite popular belief, heroin is no longer a drug that is regimented to the inner city areas. In fact, heroin is abundant in the suburbs and is affecting middle class and affluent families. This latest incident may help shed light on the heroin and drug problems affecting Middlesex County and New Jersey.

Kyle Lankey, the son of the mayor, was arrested this past Monday night after police officers responded to a call about a suspicious vehicle idling in front of a house. Policed arrived and found him unconscious behind the wheel of his car on the house’s front lawn. An investigation and subsequent search of the vehicle turned up heroin, pills, and a small amount of marijuana in his possession, according to reports.

Among the most serious of charges, was one count of possession of a controlled dangerous substance with the intent to distribute based on the fact that police allegedly found 200 packets of heroin and about $400 in cash. He was arrested and taken into custody and later released on $25,000 bail. The bail was set by the Dennis Fackelman, the Piscataway Municipal Court Judge to avoid any appearance of a conflict of interest because the defendant’s father is Mayor of Edison and is therefore responsible for appointing judges in Edison Municipal Court. The amount of heroin allegedly seized, is most likely indicative of a third degree indictable crime which is punishable by 3 – 5 years in state prison. Moreover, these charges will most likely be handled in the Middlesex County Superior Court in New Brunswick.
