Old Bridge has some of the highest heroin abuse cases reported in New Jersey with 192 in 2012 and 178 in 2013 based on reports from the Division of Addiction Services in the New Jersey Department of Human Services. (Statistics for 2014 have not been released yet) However, the problem goes far beyond Old Bridge, as there are two towns in Middlesex County alone that have more reported heroin use. The reported heroin abuse cases are only the ones that police and emergency personnel know about and most translate into arrests and charges for Heroin Possession, being under the influence of CDS, or possession of a hypodermic needle. However, these statistics do not include the countless others arrested for heroin which is found as the result from motor vehicle stops and search warrants. A significant amount of these charges result in Heroin Distribution cases as the law assumes you have an intent to distribute the drug to others if you have numerous folds or decks on you – which is often referred to as “bundles” and “bricks”. However, in reality most users have numerous bags in their possession and use as many as 10 doses each day in order to feed their growing habit.
An experienced criminal defense attorney can be invaluable when it comes to challenging the legal standards and elements of the State’s case against. Moreover, your lawyer can serve as your advocate and take the position that you are more deserving of treatment rather than incarceration for the incident that you have been charged for. Our attorneys have defended clients against hundreds of heroin charges and related crimes and we are often able to secure a downgrade of the charges or admittance in to Pre-Trial Intervention for first time offenders so that the charges are dismissed upon successful completion. For clients with prior records, we are often able to secure non-custodial probation or Drug Court, when circumstances allow, so incarceration is avoided.
